Terms of Service - Trellis

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Trellis Digital Inc. ("Trellis," "we," "us," or "our") governing your access to and use of the Trellis mobile application and website at findtrellis.app (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to create an account and use the Service. By using Trellis, you represent and warrant that you meet this age requirement. The Service is designed for families; however, only adults may hold accounts. Children do not have their own accounts — they are represented as part of a family profile managed by an adult account holder.

3. Account Registration and Security

To use the Service, you must create an account using a valid email address or phone number, or through a supported third-party authentication provider (such as Google or Apple). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access or use of your account.

You may link multiple sign-in methods (email, phone, Google, Apple) to a single account. You may not create multiple accounts for the same person or transfer your account to another individual.

4. Family Profiles and Children's Information

Trellis allows you to create a family profile that may include information about your children, such as first name, birth year, birth month, and gender. This information is used solely for the purpose of matching your family with compatible families nearby. By providing this information, you represent that you have the legal authority to do so and consent to its use as described in our Privacy Policy.

Children under the age of 13 do not create accounts, provide personal information directly, or interact with the Service independently. All children's information is entered and managed by an adult account holder.

5. Acceptable Use

You agree to use the Service in a manner consistent with its intended purpose — connecting families for real-world social interaction. You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable law or regulation
Harass, abuse, threaten, or intimidate other users
Post content that is hateful, violent, sexually explicit, or exploitative
Impersonate any person or entity, or misrepresent your identity or affiliation
Use the Service to advertise, solicit, or promote commercial products or services without our prior written consent
Attempt to gain unauthorized access to other users' accounts or to our systems
Use automated means (bots, scrapers, crawlers) to access or collect data from the Service
Upload content containing malware, viruses, or other harmful code
Engage in any conduct that could endanger the safety of children or families

6. Content and Moderation

You retain ownership of the content you post on Trellis, including text, photos, reviews, and recommendations. By posting content, you grant Trellis a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content within the Service for the purpose of operating and improving the platform.

All user-generated content is subject to automated and human moderation. We use AI-powered content moderation to review posts, messages, comments, reviews, and profile information. Content that violates our community standards may be removed without notice. We reserve the right to remove any content at our sole discretion.

We maintain a strike system for content violations:

First violation: Warning and content removal
Second violation: Temporary restriction on posting (24 hours)
Third or subsequent violations: Account suspension or permanent ban

Certain categories of content — including child exploitation material, threats of violence, and terrorism-related content — result in immediate account suspension and may be reported to law enforcement.

7. Meetups and In-Person Events

Trellis facilitates the organization of in-person meetups and events between users. Trellis is not an organizer, host, or participant in these events. You acknowledge that:

Attendance at any meetup or event is entirely at your own risk
Trellis does not conduct background checks on users
Trellis is not responsible for the conduct of any user at an in-person event
You are responsible for the safety and supervision of your children at all times during any meetup

8. Recommendations and Reviews

Trellis allows users to share recommendations for local services, businesses, schools, and other resources, and to leave reviews and ratings. These recommendations and reviews reflect the opinions of individual users and do not represent the views or endorsements of Trellis. We do not verify the accuracy, quality, or safety of any recommended service or business.

Business owners may claim their listing and respond to reviews. Trellis does not verify business ownership claims beyond reasonable measures and is not liable for disputes between users and businesses.

9. Payments and Subscriptions

Certain features of the Service may require a paid subscription. Payments are processed through Stripe, a third-party payment processor. By purchasing a subscription, you agree to Stripe's terms of service in addition to these Terms. Subscription fees are billed in advance on a recurring basis. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

We reserve the right to change subscription pricing with reasonable notice. Price changes will not affect your current billing period.

10. Identity Verification

Trellis may offer optional identity verification through Stripe Identity. If you choose to verify your identity, your verification data is processed by Stripe in accordance with their privacy policy. Verification is voluntary but may unlock additional features or a verified badge on your profile. Trellis does not store raw identity documents — verification status is provided by Stripe.

11. Messaging

The Service includes messaging features for direct conversations between users and group conversations. All messages are subject to content moderation. You agree not to use messaging for spam, harassment, commercial solicitation, or any purpose that violates these Terms. We reserve the right to review message content for moderation and safety purposes as described in our Privacy Policy.

12. Intellectual Property

The Service, including its design, software, features, and content created by Trellis (excluding user-generated content), is the property of Trellis Digital Inc. and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

The Trellis name, logo, and all related marks are trademarks of Trellis Digital Inc. You may not use our trademarks without prior written permission.

13. Third-Party Services

The Service integrates with third-party services including but not limited to:

Stripe for payment processing and identity verification
Apple and Google for authentication and app distribution
Google Cloud Translation for content translation features
Amazon Web Services for infrastructure and content moderation

Your use of these third-party services is subject to their respective terms and privacy policies. Trellis is not responsible for the practices of third-party service providers.

14. Termination

You may delete your account at any time through the app settings. We may suspend or terminate your account if you violate these Terms, if required by law, or if we reasonably believe your account poses a risk to the safety of other users.

Upon account termination, your profile and content will no longer be visible to other users. We may retain certain data as required by law or for legitimate business purposes as described in our Privacy Policy.

15. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TRELLIS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT GUARANTEE THE ACCURACY OR RELIABILITY OF ANY CONTENT POSTED BY USERS, INCLUDING RECOMMENDATIONS AND REVIEWS.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRELLIS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO TRELLIS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

17. Indemnification

You agree to indemnify, defend, and hold harmless Trellis and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, your participation in any meetup or event, or your violation of these Terms.

18. Governing Law and Disputes

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the Canadian Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction. You agree to resolve disputes on an individual basis and waive any right to participate in a class action.

19. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
